An ordinance amending Chapter 10.18 of the Metropolitan Code to prohibit smoking on playgrounds owned by the Metropolitan Government.
WHEREAS, 2020 Tennessee Laws Pub. Ch. 529 (S.B. 9) allows local governments to prohibit smoking on the grounds of a playground by adopting an ordinance approved by a two-thirds vote of the legislative body of the local government; and
WHEREAS, 2020 Tennessee Laws Pub. Ch. 529 defines “playground” as an indoor or outdoor facility that is intended for recreation of children and owned by the local government; and
WHEREAS, in the interest of protecting public health, the Metropolitan Council deems it appropriate to prohibit smoking at all Metro-owned playgrounds.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Chapter 10.18 of the Metropolitan Code is hereby amended by adding the following provision at the end of Section 10.18.020:
“Further, smoking is prohibited on the grounds of all playgrounds owned by the metropolitan government.”
Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
