A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Shaundelle Brooks, individually and as next of kin to Akilah DaSilva, against the Metropolitan Government of Nashville and Davidson County in the amount of $35,000.00 with said amount to be paid out of the Self-Insured Liability Fund.
WHEREAS, on April 22, 2018, the deceased, Akilah DaSilva was a patron at the Waffle House located at 3571 Murfreesboro Pike, Antioch, TN 37013 in Davidson County, when he sustained gunshot wounds during a mass shooting, ultimately resulting in his death; and,
WHEREAS, the emergency response was initially directed to the wrong Waffle House on Murfreesboro Pike by the Department of Emergency Communications; and,
WHEREAS, Ms. Shaundelle Brooks, individually and on behalf of Akilah DaSilva, has asserted claims against the Metropolitan Government for the delay in the emergency response caused by initially dispatching the police to the wrong Waffle House on Murfreesboro Pike; and,
WHEREAS, the Department of Emergency Communication has agreed to consider, in good faith, policy proposals submitted by Ms. Shaundelle Brooks concerning two topical areas: the timely transmission of caller GPS coordinates; and the documentation of employee errors in employees’ personnel files; and,
WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that any and all claims or causes of action brought or that could have been brought by Shaundelle Brooks, individually and as next of kin to Akilah DaSilva, related to the events detailed above be compromised and settled for $35,000.00, and that this amount be paid from the Self-Insured Liability Fund.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claim of Shaundelle Brooks, individually and as next of kin to Akilah DaSilva, for the sum of $35,000.00 with said amount to be paid from the Self-Insured Liability Fund.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
