Resolution RS2019-1656

A resolution approving Amendment Number One to a Participation Agreement between the Metropolitan Government of Nashville and Davidson County and Capitol View Joint Venture concerning the construction of public park improvements and the donation of a parcel of property.

WHEREAS, the Metropolitan Government of Nashville and Davidson County previously entered into a Participation Agreement with Capitol View Joint Venture to construct public park improvements and donate a parcel of property, which was approved by Ordinance BL2018-1216; and,

WHEREAS, the State of Tennessee, Tennessee Department of Environment and Conservation (“TDEC”) awarded a $100,000.00 grant to the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Parks and Recreation, to develop Capitol View Park, which was approved by Resolution RS2019-1553; and,

WHEREAS, Capital View Joint Venture will be performing the improvements funded by the grant awarded by TDEC; and,

WHEREAS, there is a need to amend the Participation Agreement through Amendment Number One, a copy of which is attached hereto, to address the reimbursement of Capital View Joint Venture for the performance of services funded by TDEC; and,

WHEREAS, Ordinance BL2018-1216 provides that amendments to the Participation Agreement may be approved by resolution of the Metropolitan Council; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment One be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Amendment Number One to the Participation Agreement between The Metropolitan Government of Nashville and Davidson County and Capitol View Joint Venture, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
