Resolution RS2019-1738

A resolution approving an intergovernmental license agreement with the State of Tennessee, Department of Transportation, for the use and benefit of the Board of Parks and Recreation in the construction and maintenance of a pedestrian greenway (Proposal No. 2019M-007AG-001).

WHEREAS, the State of Tennessee, Department of Transportation (“TDOT”), has offered to license, pursuant to the terms of the agreement attached hereto as Exhibit 1, to the Metropolitan Government of Nashville and Davidson County, by and through the Board of Parks and Recreation, a portion of State right-of-way to construct and maintain a pedestrian greenway; and,

WHEREAS, the Metropolitan Government of Nashville and Davidson County plans to construct and maintain improvements along Interstate-440 adjacent to the northbound ramp onto northeast bound West End Avenue; and,

WHEREAS, the Board of Parks and Recreation has approved the license agreement; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes Metro to enter agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental license agreement be approved. .

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That the intergovernmental license agreement between The Metropolitan Government of Nashville and Davidson County and TDOT, attached hereto and incorporated herein as Exhibit 1, is hereby approved, and the Metropolitan Mayor is authorized to execute said agreement.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
