Resolution RS2020-283

A resolution approving an intergovernmental agreement between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the resurfacing and repairing of 2.42 miles of 31st Avenue S., Blakemore Avenue and Wedgewood Avenue, Project No. 19SAR1-S8-008, State Aid Route No. SA-19028(3).

WHEREAS, a state-aid highway system consisting of certain routes in the county road network was established by TCA, Section 54-4-401; and,

WHEREAS, pursuant to the terms of said Agreement with the State of Tennessee, Department of Transportation (“TDOT”), attached to this resolution and incorporated herein as Exhibit A, TDOT agrees to appropriate and expend certain funds for State Aid Highway projects and the Metropolitan Government of Nashville and Davidson County (“METRO”) agrees to match such expenditures up to two percent (2%) for State Aid Highway System projects; and,

WHEREAS, the estimated cost for the repair and resurfacing is $2,144,900.00, which is shared 75% TDOT and 25% METRO, for a total estimated cost to METRO of $536,225.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104 authorizes the Metropolitan Government to enter agreements with TDOT by resolution; and,

WHEREAS, approval of this agreement will benefit the citizens of The Metropolitan Government of Nashville and Davidson County.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Public Works, for the resurfacing and repairing of 2.42 miles of 31st Avenue S., Blakemore Avenue and Wedgewood Avenue, Project No. 19SAR1-S8-008, State Aid Route No. SA-19028(3), attached hereto as Exhibit A, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

Section 2. That the amount of this agreement be appropriated to the Metropolitan Government Department of Public Works based on the revenues estimated to be received and any match to be applied.

Section 3. This resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
