Resolution RS2018-1110

A resolution amending the scope of the determinations to be rendered by the Report and Recommendations of the Special Committee established pursuant to Resolution No. RS2018-1039.

WHEREAS, on February 6, 2018, the Metropolitan Council adopted Resolution No. RS2018-1039, establishing a Special Committee to investigate the circumstances involving travel and other expenses, including overtime expenses, potentially related to former Mayor Megan Barry's admitted improprieties involving an employee of the Metropolitan Government to determine if there was any improper use of public money; and

WHEREAS, Resolution No. RS2018-1038 further provided that, by a resolution passed by the Council, the Special Committee may engage the services of outside legal professionals; and

WHERAS, Resolution No. RS2018-1038 further directed that the Special Committee shall prepare a Report and Recommendations to the Council about its findings and any recommendations for further action; and

WHEREAS, on March 6, 2018, then-Mayor Megan Barry and former Metropolitan Nashville Police Department Sgt. Rob Forrest entered pleas of guilty before Judge Monte Watkins of the Davidson County Criminal Court Division V of the Twentieth Judicial District; and

WHEREAS, the pleas of guilty entered by former Mayor Barry and Sgt. Forrest effectively resolved the question of whether any improper use of public money had occurred; and

WHEREAS, despite the tendered guilty pleas, little to no information was divulged regarding the mechanisms by which the misuse of funds occurred, nor the frequency, methods, or scope of such misuse of funds – thereby depriving the Special Committee, and the public at large, of information necessary to formulate future policies and regulations to prevent such occurrences, as may be indicated; and

WHEREAS, it is therefore fitting and proper that the investigation by the Special Committee proceed, and that the original Resolution No. RS2018-1039 be amended to clarify that the Special Committee shall prepare a Report and Recommendations to the Council about its findings, any recommendations for further action, as well as recommendations for additions or revisions to Metropolitan Government Code of Laws, policies, or regulations.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Resolution No. RS2018-1039 is hereby amended to clarify that the Special Committee established pursuant to said Resolution shall prepare a Report and Recommendations to the Council about its findings, any recommendations for further action, as well as recommendations for additions or revisions to Metropolitan Government Code of Laws, policies, or regulations.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
