Resolution RS2020-267

A resolution to amend Ordinance No. BL2019-1737 to authorize The Metropolitan Government of Nashville and Davidson County to abandon existing public sanitary and combination mains, combination sewer manholes/inlets, and easements and to accept new sanitary sewer and combination sewer mains, sanitary sewer manholes, combination sewer manholes/inlets, and easements, for six properties located on Broadway, Lyle Avenue and 20th Avenue South (MWS Project No. 19-SL-119 and Proposal No. 2019M-050ES-002).

WHEREAS, Ordinance No. BL2019-1737, approved August 7, 2019, authorized the abandonment of approximately 127 linear feet of existing eight inch sanitary sewer main, approximately 424 linear feet of existing 48 inch combination sewer main, two existing combination sewer manholes/inlets, and easements, and the acceptance of approximately 522 linear feet of new 12 inch sanitary sewer main (PVC), approximately 62 linear feet of new 48 inch combination sewer main (RCP), approximately 546 linear feet of new 60 inch combination sewer main (RCP), five new sanitary sewer manholes, six new combination sewer manholes/inlets and easements, for five properties located on Broadway, Lyle Avenue and 20th Avenue South; and,

WHEREAS, the abandonment of an additional approximately 25 linear feet of existing eight inch sanitary sewer main, an additional approximately 115 linear feet of existing 48 inch combination sewer main, an additional two combination manholes, and approximately 128 linear feet of existing 10 inch sanitary sewer main and easements, and the acceptance of approximately 22 linear feet of new eight inch sanitary sewer main (PVC), approximately 130 linear feet of new 10 inch sanitary sewer main (PVC), approximately 174 linear feet of new 18 inch sanitary sewer main (PVC), approximately 397 linear feet new 18 inch sanitary sewer main (DIP), four additional sanitary sewer manholes, approximately 405 linear feet of new 66 inch combination sewer main (RCP), and easement, for six properties located on Broadway, Lyle Avenue and 20th Avenue South, are needed to construct project No. 19-SL-119; and,

WHEREAS, the previously approved acceptance of approximately 522 linear feet of new 12 inch sanitary sewer main (PVC), approximately 62 linear feet of new 48 inch combination sewer main, and two of the six combination sewer manholes and easements, are no longer needed to construct Project No. 19-SL-119; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 050ES-002 on February 21, 2020, for the abandonment and acceptance of said public sanitary and combination mains, combination sewer manholes/inlets, and easements; and,

WHEREAS, Ordinance No. BL2019-1737 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2019-1737 is hereby amended by deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 152 linear feet of existing eight inch sanitary sewer main, approximately 128 linear feet of existing 10 inch sanitary sewer main, approximately 539 linear feet of existing 48 inch sewer main and four existing combination sewer manholes/inlets, and easements, and to accept approximately 22 linear feet of new eight inch sanitary sewer main (PVC), approximately 130 linear feet of new 10 inch sanitary sewer main (PVC), approximately 174 linear feet of new 18 inch sanitary sewer main (PVC), approximately 397 linear feet new 18 inch sanitary sewer main (DIP), 153 linear feet of new 60 inch sanitary sewer main (RCP), approximately 405 linear feet of new 66 inch sanitary sewer main (RCP), nine sanitary sewer manholes, four combination sewer manholes and easements, for six properties located on Broadway, Lyle Avenue and 20th Avenue South, as shown on exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.


Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
