Resolution RS2020-525 (as amended)

A resolution approving an intergovernmental agreement between the United States Marshals Service and The Metropolitan Government of Nashville and Davidson County for detention services for federal detainees.

WHEREAS, the United States Marshals Service has requested that the Metropolitan Government house certain federal detainees at the Davidson County Sheriff’s Office Downtown Detention Center, who are individuals who have been charged with federal offenses and are awaiting trial, or who have been sentenced and are awaiting designation and transport to a Bureau of Prisons facility; and,

WHEREAS, the intergovernmental agreement attached hereto and incorporated herein provides terms for the agreement between the agencies; and,

WHEREAS, T.C.A. § 12-9-104 authorizes the Metropolitan Government to enter into intergovernmental agreements with agencies of the federal government for cooperative projects by resolution of the governing body; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement between the United States Marshals Service and The Metropolitan Government of Nashville and Davidson County for detention services for federal detainees, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
