Resolution RS2020-427

A resolution to amend Ordinance No. BL2019-1712 to authorize The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main, sanitary sewer manholes and easements, and to accept new sanitary sewer manholes and easements for five properties located on Belmont Boulevard and Compton Avenue (MWS Project No. 19-SL-21 and Proposal No. 2019M-043ES-002).

WHEREAS, Ordinance No. BL2019-1712, approved July 17, 2019, authorized the abandonment of approximately 363 linear feet of existing eight inch sanitary sewer main, one sanitary sewer manhole and easements, and the acceptance of approximately 278 linear feet of new eight inch sanitary sewer main, five sanitary sewer manholes and easements, for six properties located on Compton Avenue, Belmont Boulevard and Delmar Avenue; and,

WHEREAS, the abandonment of an additional approximately 164 linear feet of existing eight inch sanitary sewer main, an additional 2 sanitary sewer manholes and easements, and the acceptance of two of the previously approved five sanitary sewer manholes and easement, for five properties now located at 2100 Belmont Boulevard and 1501A, 1503, 1505, and 1507 Compton Avenue, are needed to construct Project No. 19-SL-21; and,

WHEREAS, the previously approved acceptance of approximately 278 linear feet of eight inch sanitary sewer main and three of the five sanitary sewer manholes and easements, are no longer needed to construct Project No. 19-SL-21; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 043ES-002 on April 7, 2020, for the abandonment and acceptance of said sanitary sewer mains, sanitary sewer manholes, easements: and,

WHEREAS, Ordinance No. BL2019-1712 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the ordinance No. BL2019-1712 is hereby amended by deleting section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 527 linear feet of existing eight inch sanitary sewer main, three sanitary sewer manholes and easements, and to accept two sanitary sewer manholes and easements, for five properties located at 2100 Belmont Boulevard and 1501A, 1503, 1505, and 1507 Compton Avenue, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
