Resolution RS2018-1175
A resolution to amend Ordinance No. BL2015-12 to authorize The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer and water easement rights and accept fire hydrants, for properties located at 710 and 701B Cleo Miller Drive, formerly 1034 West Eastland Avenue (MWS Project Nos. 15-SL-27 and 15-WL-29 and Proposal No. 2015M-041ES-002).
WHEREAS, Ordinance No. BL2015-12, approved November 5, 2015, authorized the abandonment of approximately 475 linear feet of existing eight inch sanitary sewer main, approximately 385 linear feet of existing six inch water main, and the acceptance of approximately 971 linear feet of six inch water main, approximately 839 linear feet of eight inch DIP sanitary sewer line and five manhole units for properties located at 710 and 701B Cleo Miller Drive, formerly 1034 West Eastland Avenue; and,
WHEREAS, the abandonment of existing sanitary sewer and water easement rights, and the acceptance of three fire hydrants, are needed to construct project number 15-SL-27 and 15 WL 29; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-041ES-002 on April 11, 2018, for the abandonment of said easements and acceptance of said fire hydrants; and,
WHEREAS, Ordinance No. BL2015-12 provides that amendments to the legislation shall be approved by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon existing sanitary sewer and water easement rights, and to accept three fire hydrants for properties located at 710 and 701B Cleo Miller Drive, formerly 1034 West Eastland Avenue, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.
Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
