Resolution RS2019-1532

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Timothy Warren against the Metropolitan Government in the amount of $110,000.00, and reasonable attorney’s fees not to exceed $50,000.00, and that said amounts be paid out of the Judgments and Losses Fund.

WHEREAS, Timothy Warren filed a civil rights lawsuit against the Metropolitan Government and several individual employees of the Davidson County Sheriff’s Office, alleging a Fourteenth Amendment excessive use of force claim on December 19, 2014; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government; and recommends that any and all claims or causes of action brought or that could have been brought by Timothy Warren related to the events detailed above against the Metropolitan Government, be compromised and settled for $110,000.00, and reasonable attorney’s fees, not to exceed $50,000.00, and that these amounts be paid from the Judgments and Losses Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the civil rights claim of Timothy Warren for the sum of $110,000.00 and reasonable attorney’s fees, not to exceed $50,000.00, and with said amounts to be paid from the Judgments and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
