Resolution RS2019-1611

A resolution approving the First Amendment to the Lease Agreement between The Metropolitan Government of Nashville and Davidson County and the Nashville Academy Theatre and Nashville Children’s Theatre Association for certain real property located at 724 Second Avenue South, Nashville, Tennessee (Proposal No. 2019M-001AG-001).

WHEREAS, Ordinance No. BL2004-127 approved a Lease Agreement and Addendum between The Metropolitan Government of Nashville and Davidson County and The Nashville Academy Theatre and Nashville Children’s Theatre Association, for the real property located at 724 Second Avenue South, Nashville, Tennessee; and,

WHEREAS, the term of the Lease commenced on December 1, 2003 and was scheduled to end on November 30, 2018; and,

WHEREAS, Section 3(b) of the Lease Agreement provides that the Lease may be extended for three (3) consecutive five (5) year terms upon the agreement of the parties; and,

WHEREAS, the parties desire to extend the term of the Lease Agreement for five years; and,

WHEREAS, the parties also desire to amend the Lease to further address the obligations of each party regarding utilities and maintenance; and,

WHEREAS, Ordinance No. BL2004-127 states that any amendments to the Lease Agreement shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the First Amendment to the Lease Agreement between The Metropolitan Government of Nashville and Davidson County and The Nashville Academy Theatre and Nashville Children’s Theatre Association, for the real property located at 724 Second Avenue South, Nashville, Tennessee, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Director of Public Property is authorized to execute the same.

Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
