A resolution approving Amendment Three to the Participation Agreement between the Metropolitan Government of Nashville and Davidson County, through the Metropolitan Department of Public Works, and Century Farms LLC, for the design and construction of access roads connecting Cane Ridge Road and Old Franklin Road to the I-24 Interchange at Hickory Hollow Parkway (Proposal No. 2018M-016AG-001).
WHEREAS, Ordinance BL2017-746 approved a participation agreement between the Metropolitan Government of Nashville and Davidson County (“Metro”) and Century Farms, LLC, (‘Century Farms”) for the design and construction of local roads that will connect to the interchange project at a shared cost of approximately $24,000,000, where Century Farms will pay $12,000,000 and Metro will pay $12,000,000; and,
WHEREAS, the actual construction bids and engineering costs total $25,897,694.45, and Metro and Century Farms each agree to pay 50% of the cost, or approximately $12,440,000; and,
WHEREAS, it is prudent to allow for contingencies for road construction projects for a total budget amount of $28,000,000, split 50% - 50% between Century Farms and Metro; and,
WHEREAS, Metro Public Works is requesting authority from the Metropolitan Council to utilize up to $14,000,000, approved in prior spending programs, to finish Metro’s share of engineering and construction for the project; and,
WHEREAS, the completion of the Project and the provision of such public infrastructure improvements will benefit both parties and the general community of Nashville and Davidson County, Tennessee.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Amendment Three to the Participation Agreement between the Metropolitan Government of Nashville and Davidson County, through the Metropolitan Department of Public Works, and Century Farms LLC, attached hereto as Exhibit A, and incorporated herein by reference, is hereby approved, and that the Metropolitan Mayor is authorized to execute the same.
Section 2. Future amendments to this legislation shall be approved by resolution of the Metropolitan Council.
Section 3. This resolution shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville & Davidson County requiring it.
