Resolution RS2019-1663

A resolution amending Ordinance No. BL2018-1059 to authorize The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main and easement and to accept new sanitary sewer main and any associated easements for five additional properties located on Nolensville Pike (MWS Project No. 16 SG-0045 and Proposal No. 2019M-018ES-001).

WHEREAS, Ordinance No. BL2018-1059, approved February 21, 2018, authorized the abandonment of approximately 153 linear feet of existing eight inch sewer main and easements and the acceptance of approximately 782 linear feet of new eight inch sewer main and any associated easements, for properties located at 5824 and 5832 Nolensville Pike; and,

WHEREAS, the abandonment of an additional approximately 185 linear feet of existing eight inch sanitary sewer main and easements, and the acceptance of an additional approximately 164 linear feet of new eight inch sanitary sewer main and any associated easements, for five additional properties located at 5833, 5835, 5837, 5841 and 5843 Nolensville Pike, are needed to construct project number 16-SG-0045; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 018ES-001 on February 26, 2019, for the abandonment and acceptance of said additional sewer mains and easements; and,

WHEREAS, Ordinance No. BL2018-1059 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2018-1059 is hereby amended by deleting section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 338 linear feet of existing eight inch sanitary sewer main and easements, and to accept approximately 946 linear feet of new eight inch sanitary sewer main and any associated easements, for seven properties located on Nolensville Pike, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
