Resolution RS2018-1475

A resolution approving an amendment to an agreement between the Metropolitan Government of Nashville and Davidson County and the City of Oak Hill with respect to the performance of municipal functions.

WHEREAS, the City of Oak Hill is a satellite city located entirely within Davidson County, Tennessee; and,

WHEREAS, Section 18.15 of the Metropolitan Charter requires the Metropolitan Government to furnish satellite cities with governmental services comparable to the services provided in other parts of the General Services District; and,

WHEREAS, pursuant to Resolution No. RS2013-693, the Metropolitan Government entered into an agreement (the “Agreement”) with the City of Oak Hill for the purposes of clarifying responsibility for the performance of certain municipal functions therein; and,

WHEREAS, the City of Oak Hill provides its own roadway maintenance, which is a service the Metropolitan Government provides to areas within the General Services District; and,

WHEREAS, the Metropolitan Government and the City of Oak Hill propose to amend the Agreement to authorize the Metropolitan Government to reimburse Oak Hill for a portion of the roadway maintenance it provides; and,

WHEREAS, Tenn. Code Ann. §§ 12-9-101, et seq., authorizes the governing bodies of political subdivisions of the state to approve cooperative agreements by resolution; and,

WHEREAS, it is in the best interests of the Metropolitan Government that the amendment to the agreement attached and incorporated into this resolution as Exhibit A be approved.

NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the proposed amendment to the agreement between the Metropolitan Government and the City of Oak Hill is hereby approved.

Section 2. That this Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
