Resolution RS2019-15

A resolution amending Ordinance No. BL2019-1553 to authorize The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main and easements and to accept one sanitary sewer manhole and easement, for two properties located at 2995 Sidco Drive and 4030 Armory Oaks Drive (MWS Project No. 18-SL-154 and Proposal No. 2019M-016ES-002).

WHEREAS, Ordinance No. BL2019-1553, approved April 24, 2019, authorized the abandonment of approximately 207 linear feet of existing 15 inch sanitary sewer main, a sanitary sewer manhole and easements, and the acceptance of approximately 271 linear feet of new 15 inch sanitary sewer main (PVC), four sanitary sewer manholes and easements, for property located at 2995 Sidco Drive; and,

WHEREAS, the abandonment of an additional approximately 267 linear feet of existing 15 inch sanitary sewer main and easements (with approximately 307 linear feet to be converted for private use), and the acceptance of one of the previously approved four sanitary sewer manholes and easement, for properties located at 2995 Sidco Drive and 4030 Armory Oaks Drive, are needed to construct project number 18-SL-154; and,

WHEREAS, the previously approved acceptance of approximately 271 linear feet of 15 inch sewer main (PVC) and three of the four sewer manholes and easements, are no longer needed to construct Project No. 18-SL-154; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M-016ES-002 on August 22, 2019, for the abandonment and acceptance of said additional sanitary sewer mains, sanitary sewer manholes and easements; and,

WHEREAS, Ordinance No. BL2019-1553 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2019-1553 is hereby amended by deleting section 1 in its entirety and replacing it with the following:

The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 474 linear feet of existing 15 inch sanitary sewer main and easements with approximately 307 linear feet to be converted to private use, and to accept one sanitary sewer manhole and easement, for two properties located at 2995 Sidco Drive and 4030 Armory Oaks Drive, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this resolution.

Section 3. This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
