Resolution RS2019-1595

A resolution amending Ordinance No. BL2018-1341 to authorize The Metropolitan Government of Nashville and Davidson County to abandon existing public utility easement rights, for properties located at Demonbreun Street (unnumbered) and 1219 McGavock Street, formerly Alley 235 (MWS Project No. 18-SL-73 and Proposal No. 2019M-001AB-001).

WHEREAS, Ordinance No. BL2018-1341, approved November 13, 2018, authorized the abandonment and removal of approximately 236 linear feet of 10 inch sanitary sewer main and two sewer manholes, for properties located at Demonbreun Street (unnumbered) and 1219 McGavock Street; and,

WHEREAS, the abandonment of approximately 214 linear feet of existing public utility easement rights, in former Alley 235, retained by Ordinance No. BL2018-1225, is needed to construct project number 18-SL-73; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2019M 001AB-001 on December 19, 2018, for the abandonment of said easements; and,

WHEREAS, Ordinance No. BL2018-1341 provides that amendments to the legislation shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2018-1341 is hereby amended by deleting section 1 in its entirety and replacing it with the following:
The Metropolitan Government of Nashville and Davidson County is authorized to abandon and remove approximately 236 linear feet of 10 inch sewer main and two sewer manholes and to abandon approximately 214 linear feet of existing public utility easement rights, in former Alley 235, for properties located at Demonbreun Street (unnumbered) and 1219 McGavock Street, as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
