Resolution RS2018-1179

A resolution establishing a requirement of a four (4) hour minimum annual continuing education and training for all members of the Metropolitan Board of Equalization and all Board of Equalization hearing officers.

WHEREAS, pursuant to TENN. CODE ANN. § 67-1-403, the Metropolitan Mayor shall require all Metropolitan Board of Equalization members and hearing officers to complete annual continuing education and training on duties and responsibilities of their office as a condition of appointment or continued service; and,

WHEREAS, pursuant to TENN. CODE ANN. § 67-1-403, the county legislative body shall by resolution establish a minimum of four (4) hours training for board members and hearing officers to complete annually and minimum recordkeeping requirements related to members’ certificates of attendance; and,

WHEREAS, pursuant to TENN. CODE ANN. § 67-1-403, the subjects for training and continuing education shall include board governance, open meeting requirements, and other topics reasonably related to the duties of a member of the Metropolitan Board of Equalization; and,

WHEREAS, pursuant to TENN. CODE ANN. § 67-1-403, any association or organization with appropriate knowledge and experience may prepare a training and continuing education curriculum for county boards of equalization covering the subjects set forth in subdivision (e)(3) of Tenn. Code Ann. § 67-1-403 to be submitted to the comptroller of the treasury for review and approval prior use; and,

WHEREAS, pursuant to TENN. CODE ANN. § 67-1-403, mandatory annual continuing education and training is only required under subsection (e) to the extent that such education and training is provided by the comptroller of the treasury free of charge.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That a requirement for all Metropolitan Board of Equalization members and hearing officers to complete a minimum of four (4) hours of annual continuing education and training is hereby established.

Section 2. That the subjects for the training and continuing education shall include board governance, open meetings requirements, and other topics reasonably related to the duties of a member of the county board of equalization.

Section 3. That any association or organization with appropriate knowledge and experience may prepare a training and continuing education curriculum for the Metropolitan Board of Equalization covering the subjects set for in subdivision (e)(3) of TENN. CODE ANN. § 67-1-403 to be submitted to the comptroller of the treasury for review and approval prior to use.

Section 4. Copies of all certificates of completion of the required continuing education and training for every board member and hearing officer shall be kept on file in the office of the Davidson County Assessor of Property.

Section 5. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
