ORDINANCE NO. BL2000-419
An ordinance to approve the granting of a permanent easement to the City of Forest Hills on certain property owned by the Metropolitan Government (Tax Map 144-16, Parcel 26) and presently used as the site of Percy Priest Elementary School.
WHEREAS, The Metropolitan Government of Nashville and Davidson County, owns certain property in Davidson County located on the north side of Otter Creek Road, west of Priest Road, and used as the site of Percy Priest Elementary School (Tax Map 144-16, Parcel 26); and
WHEREAS, the City of Forest Hills desires to place a permanent easement (as depicted on the attached Exhibit A) on a portion of said property for a proposed public bicycle path; and
WHEREAS, the Metropolitan Public School Board has determined that the granting of this easement would not adversely affect the usage of said property and has approved the granting of this easement at its meeting on May 23, 2000.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:
SECTION 1. The granting of a permanent easement for a public bicycle path (as depicted on the attached Exhibit A) on Tax Map 144-16, Parcel 26, to the City of Forest Hills is hereby approved.
SECTION 2. The Director of Public Property Administration, with the recommendation of the Metropolitan Public School Board, is hereby directed to grant said easement to the City of Forest Hills and is authorized to execute the necessary documents pertaining thereto.
SECTION 3. This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
