ORDINANCE NO. BL2002-1023
An ordinance amending Section 10.28.010 of the Metropolitan Code by creating a presumption of a violation of Chapter 10.28 when the growth of grass or underbrush reaches certain heights.
WHEREAS, in order to more effectively enforce Chapter 10.28 of the Metropolitan Code, Control of Excessive Vegetation, it is necessary to create a presumption of a violation when grass or underbrush reaches a certain height, thereby endangering the health, safety or welfare of the citizens of the metropolitan government.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. Section 10.28.010 of the Metropolitan Code shall be and the same is hereby amended by adding the following sentence to said section:
"There shall be a rebuttable presumption that the growth of grass or underbrush of twelve (12) inches or higher endangers the health, safety or welfare of the citizens of metropolitan government or encourages the infestation of rats or other harmful rodents or animals."
SECTION 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
Ordinance No. BL2002-1023
I move to amend Ordinance No. BL2002-1023 by amending Section 1 by adding the following sentence to the new provisions amending Section 10.28.010:
"The foregoing presumption shall not apply to any parcel of property actively maintained in keeping with an intentional landscape design or plan for vegetation growth, which landscape design or plan is on file with the metropolitan beautification and environment commission."
