ORDINANCE NO. BL2002-1054
An ordinance abandoning the sewer line and easement on Map 82-13, Parcel 116-125, 128-130, of Project No. 01-SL-151, M.D.H.A. Sewer Line and Easement Abandonment and relocating the 20" Combined Sewer/Stormwater Line. (Proposal No. 2002M-008U-09).
WHEREAS, M.D.H.A. is the owner of real property encumbered by sewer lines and sewer easements; and,
WHEREAS, the sewer line and easement to be abandoned serves no other properties; and,
WHEREAS, the sewer line and sewer easement are no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 01-SL-151, M.D.H.A. Sewer Line and Easement Abandonment, and relocating the 20" Combined Sewer/Stormwater Line on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,
WHEREAS, the Department of Water and Sewerage Services has no need for the said easement; and,
WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easement.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the sewer line and the sewer easement shown on Map 82-13, Parcel 116-125, 128-130, Project No. 01-SL-151, M.D.H.A., are declared abandoned, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment and relocating the 20" Combined Sewer/Stormwater Line.
SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requires it.
