ORDINANCE NO. BL2006-1116
An Ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.32.050 to prohibit certain temporary signs on Metropolitan Government property, all of which is more particularly described herein (Proposal No. 2006Z-127T).
WHEREAS, the Metropolitan Government has a legitimate and substantial interest in providing for adequate means of expression, whether political or commercial, but also has a legitimate and substantial interest in protecting the Metropolitan Government and its citizens from a proliferation of signs of a size or location that may cause unnecessary and undesirable visual clutter, and may threaten the health, safety and welfare of the citizens of the Metropolitan Government by adversely affecting traffic and pedestrian safety and negatively impacting the appearance of Nashville and Davidson County; and
WHEREAS, the proliferation of such signs on Metropolitan Government property and the public rights-of-way is currently having such a negative impact; and
WHEREAS, locations for such signs on private property within the area of the Metropolitan Government are available and provide a viable alternative means of expression for individuals utilizing such signs for purposes of communication.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending section 17.32.050 by adding the following new subsection T:
"T. Temporary signs of any type, other than non-commercial messages placed by or on behalf of a governmental entity, placed on any property owned by the Metropolitan Government."
Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
