An ordinance amending Title 17 of the Metropolitan Code, zoning regulations, by amending the 31st Avenue/Long Boulevard Urban Design Overlay (UDO) district, to establish parking locations, maximum raised foundation heights for particular building types, maximum building heights in feet and stories, and permitted roof types, and to clarify when architectural treatment standards apply and establish additional stormwater management requirements all of which is more particularly described herein (Proposal No. 2005UD-006U-10).


Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:
By amending the 31st Avenue/Long Boulevard Urban Design Guidelines,
…by changing the text on p.32, “Applicants shall submit three complete sets of final construction documents, including site plan and landscape plan, for review and approval prior to the issuance of building permits” to “Applicants shall submit a final UDO application for review and approval prior to the issuance of building permits. Applications shall include site plans, landscape plans and building elevations. All improvements affecting the exterior appearance of property and requiring building permits must be approved by a Design Review Committee designated by the Metropolitan Planning Commission. ”
…add “Stormwater Requirements” to p.32 stating, “All sites are subject to Stormwater review regardless of the size of the property or the disturbance area.”
…by changing the "Table of Bulk Standards by Building Type" beginning on p.32 as follows:
…replace the “Maximum Building Height” under ‘Commercial/Mixed-Use Building Type” in CE-2 with the following, “4 stories in 50 ft.” and add footnote ‘i”
…replace the “Maximum Building Height” under ‘Commercial/Mixed-Use Building Type” in CO-2 and CE-1 with the following, “4 stories in 50 ft. + additional 25 ft. if setback 10 ft. from front wall” and add footnote “i”
…add footnote "i" after footnote "h" as follows:
iROOF TYPES: Flat roofs are required on commercial/mixed-use building types
…add a footnote designation “j” after “Parking Location on Lot”
…add footnote "j" after footnote "i" as follows:
jPARKING LOCATION ON LOT: All parking structures, below grade or above grade, shall stay within the front yard, side yard and rear yard setbacks.
…by adding a section titled “Maximum Raised Foundation” with the following standards for each building type: Commercial/mixed-use: Not applicable, Live/work: Not applicable, Stacked Flat: 5 feet, Courtyard Flats: 5 feet, Townhouse: 5 feet, Cottage: 5 feet, House: 5 feet, Civic/Institutional: Not applicable.
…by moving “Architectural Treatment Standards” from p.34 to p.36 and changing as follows:
…add a section titled “Building Facades” stating, “All building facades, including those facing a public way and those not facing a public way, shall be required to meet the Architectural Treatment Standards and are subject to review.”
… adding a condition that The Planning Commission shall establish a UDO Design Review Committee with members nominated by the District Council Member and confirmed by the Planning Commission.

Section 2. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
