ORDINANCE NO. BL2008-170
An ordinance amending Section 15.68.020 of the Metropolitan Code to authorize the Metropolitan Fire Marshal to grant waivers from the mandatory installation of private fire hydrants.
WHEREAS, the Metropolitan Code currently provides that “No building or structure, or any part thereof, shall be more than five hundred feet from a hydrant, as measured by normal means of vehicular transit, via approved hard surface road. The provisions of this subsection shall not apply to a single-family residential structure constructed on a lot of five acres or more in size.” M.C.L. 15.68.020 (B); and,
WHEREAS, there are scenarios in which the Fire Marshal may determine that a fire hydrant in a particular location is not necessary and is not within the interest of the citizens of The Metropolitan Government of Nashville and Davidson County; and,
WHEREAS, the Fire Marshal is charged with enforcing the laws of the Metropolitan Government with regard to fire extinguishment and is uniquely qualified to determine whether a fire hydrant is necessary in a particular location; and,
WHEREAS, it is in the best interest of the citizens of the Metropolitan Government of Nashville and Davidson County that Section 15.68.020 of the Metropolitan Code be amended to grant the Fire Marshal authority to waive the requirement that no building or structure shall be more than five hundred feet from a hydrant.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 15.68.020 of the Metropolitan Code is hereby amended by adding the following language to the end of the first sentence of Section 15.68.020 (B): “, unless a waiver or alternative proposal is approved by the Metropolitan Fire Marshal pursuant to a review process to be developed by the Metropolitan Fire Marshal.”
Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
