ORDINANCE NO. BL2015-1129
An ordinance amending Chapter 16.24 of the Metropolitan Code to establish a Codes Offender School.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. Chapter 16.24 of the Metropolitan Code is hereby amended by amending Article III. by adding the following new Section 16.24.185:
16.24.185 Codes offender school.
There shall be established, under the supervision of the department of codes administration, a codes offender school for the purpose of providing education about the property standards provisions in the metropolitan code to persons found by a court of competent jurisdiction to be in violation of any provision of this chapter.
B. The court shall have the discretion to order any person found to be in violation of any provision of this chapter to attend such codes offender school in addition to, or in lieu of, any fine, fee or other punishment prescribed by this title.
C. The department of codes administration shall maintain records showing the names of attendees, dates of attendance, and whether such attendees satisfactorily completed the course.
D. The cost of attending such codes offender school shall be at the sole expense of the person ordered by the court to attend. The department of codes administration is authorized to charge a fee of up to ninety dollars for attending the codes offender school. All fees collected for the codes offender school shall be deposited in the general fund of the general services district to assist in covering the expenditures for instructor salaries, equipment and materials.
E. The department of codes administration shall have the authority to select a nonprofit organization(s) to operate the codes offender school subject to approval of such organization(s) by a resolution adopted by the metropolitan council receiving twenty-one affirmative votes.
Section 2. That this Ordinance shall take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
