An ordinance to amend Titles 12 and 16 of the Metropolitan Code of Laws of Nashville and Davidson County to establish a speed limit at major construction and demolition sites and to provide appropriate signage.

WHEREAS, Tennessee Code Annotated § 55-8-153(c) provides in part that the legislative bodies of Tennessee municipalities possess the power to prescribe lower speed limits within certain areas or zones, or on designated highways, avenues or streets that are not designated as state highways in their respective jurisdictions; and

WHEREAS, it is appropriate that a speed limit be imposed in construction and demolition sites to better provide for the safety and welfare of police officers, construction workers, demolition workers, drivers and others who frequent the vicinity of construction and demolition sites.


Section 1. That Chapter 12.20 of the Metropolitan Code of Laws is hereby amended by adding the following new subsection 12.20.080:
12.20.080 – Construction and demolition site restrictions

A. In any construction or demolition site which constitutes a major project as defined under Section 16.28.235.A of the Metropolitan Code of Laws, and which is located within one hundred linear feet of a public road or street, no driver of a vehicle shall drive through such site in excess of fifteen miles per hour.

B. Section 12.84.030 sets out the penalty for violation of subsection A of this section.
Section 2. That section 12.84.030 of the Metropolitan Code of Laws is hereby amended by inserting the following as subsection 7, and renumbering the remaining sections:

7. 12.20.080 – Construction and demolition site restrictions

Section 3. That section 16.28.235 of the Metropolitan Code of Laws is hereby amended by deleting subsections D and E, and inserting in lieu thereof the following new subsections D, E and F as follows:

D. Speed limit traffic signs shall be posted along all public streets and roadways within one hundred linear feet of any major project site so as to be visible to approaching motor vehicle occupants. The signs shall post a speed limit of 15 mph.

E. The project information signs required by this section shall be constructed of three-quarter-inch plywood or sheet metal. The letters on the required signs shall be black on white background, with lettering of at least one and one-half inches in height. The sign shall be prominently posted onsite in an area reasonably likely to draw the attention of persons passing by. The sign shall be a minimum of three feet in height and five feet in width, and a maximum of four feet in height and six feet in width. The sign panel shall be securely attached to the building, covered walkway, barrier, construction railing, or construction fence, or shall be mounted on posts.

F. The project information sign and motor vehicle speed limit signs must be in place at least twenty-four hours prior to commencement of any construction or demolition activity, and shall remain visible at the site until all work is completed.

Section 4. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

I. By amending Section 3 by deleting subsection E it in its entirety and substituting therefore the following:

E. The project information signs required by this section shall comply with the latest edition of the Manual for Uniform Traffic Control Devices (MUTCD).
