An ordinance authorizing the acquisition of property in fee simple by negotiation or condemnation for the purpose of building a new Metropolitan Nashville Police Precinct (Proposal No. 2017M-036PR-001).
WHEREAS, Section 2.01 of the Metropolitan Charter authorizes the Metropolitan Government to “purchase, lease, construct, maintain or otherwise acquire, hold and operate any building or other property, real or personal, for any public purpose”; and,
WHEREAS, Section 2.01 of the Metropolitan Charter further provides for the taking and appropriation of real property within the area of the Metropolitan Government for any public purpose when the public convenience requires it, and also for the purchase real estate for any public purpose; and,
WHEREAS, public convenience requires acquisition of fee simple interest in the parcels of property described in section 2 of this ordinance for the purpose of building a new police precinct and other public safety and compatible Metropolitan Government facilities (the “Project”); and,
WHEREAS, the Project is identified as Project No. 16GS0009 “South Police Precinct” in the Fiscal Year 2016 Capital Improvements Budget approved by Ordinance No. BL2015-1142.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That the Project is declared to be in the interest of public convenience.
Section 2. That the Director of Public Property Administration, or his designee, is hereby authorized to acquire in the name of The Metropolitan Government of Nashville and Davidson County, by negotiation, for a price not exceeding $7,450,000.00, or condemnation, fee simple interest in the parcels of property at 2419, 2491, 2501, 2505 Murfreesboro Pike & 2705 Highmeadows Drive, Nashville, Tennessee (Parcel ID numbers 14900032100, 14900032700, 14900032300, 14900032400 & 14900032600) and to execute such documents as may be necessary to effect the acquisition of such property.
Section 3. That acquisition of additional or different properties, for the benefit of the Project, may be approved by resolution.
Section 4. That this ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
