An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing easement rights in the former right-of-way of property located at 1930 Castleman Drive and to acquire two new sanitary sewer main easements for properties located at 1930 and 2000 Castleman Drive, (Proposal No. 2017M-056ES-001).
WHEREAS, easement rights that were retained by Council Bill 75-1352, for any existing utilities on property located in the former right-of way at 1930 Castleman Drive, are no longer needed; and,
WHEREAS, the acquisition of two new easements for sanitary sewer mains for properties located at 1930 and 2000 Castleman Drive, are needed; and,
WHEREAS, the abandonment and the acquisition has been requested by Ashley Bosshart and Elizabeth Wilson, owners; and,
WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-056ES-001 on August 15, 2017, for the abandonment and acquisition of said easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon easement rights that were retained by Council Bill 75-1352, for any existing utilities in the former right-of-way of property located at 1930 Castleman Drive, and to acquire two new sanitary sewer main easements, for properties located at 1930 and 2000 Castleman Drive, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acquisition authorized by this ordinance.
Section 3. Amendments to this legislation shall be approved by resolution.
Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
