RESOLUTION NO. RS2002-1075
A resolution authorizing the acquisition of an easement in real property by negotiation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a North Nashville Police Precinct and the granting of an easement in real property by The Metropolitan Government to the grantor as consideration for the easement (Proposal No. 2002M-063U-08).
WHEREAS, it is the intent of the Metropolitan Police Department to construct a new North Precinct; and.
WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:
"Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the metropolitan government at a fixed price, subject to the approval of the metropolitan council by resolution, and no purchase shall be consummated until it has been so approved by the metropolitan council"; and
WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (ATTACHMENT 1) to acquire an easement in real property located in Davidson County as shown on EXHIBIT A and incorporated into this resolution by reference; and
WHEREAS, as consideration for the acquisition of the necessary easement The Metropolitan Government will convey an easement in real property to the grantee as shown on EXHIBIT B; and
WHEREAS, it is deemed in the best interest of the Metropolitan Government to approve the acquisition of said property right and dispose of an easement to the grantor.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The
Director of Public Property is authorized to exercise the option (ATTACHMENT
1) to acquire the property (a portion of Map 81-02 Parcel 205) as shown in Exhibit
A and to execute the necessary documents pertaining thereto.
Section 2. The Director of Public Property is authorized and directed to dispose of the easement in the surplus property, as consideration for the acquisition and in accordance with the option.
Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
