RESOLUTION NO. RS2002-1079
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Quinten Crawford, Lencoya Crawford, Shawn Mitchell and Coleshawn Mitchell against The Metropolitan Government of Nashville and Davidson County in the amount of $57,000.00, and directing that this amount be paid from the Self Insured Liability Account.
Whereas, on January 22, 2001, the members of the Crawford family, parents Quinten and Lencoya Crawford; 7-year old daughter Coleshawn Mitchell; and 5-year old son Shawn Mitchell, were traveling on Gallatin Road and were struck and injured by a vehicle being pursued by a Metropolitan police officer; and
Whereas, a lawsuit was filed in the First Circuit Court for Davidson County, Tennessee; and
Whereas, after investigation, the Department of Law believes the settlement amount of $57,000.00 is fair and reasonable and will be distributed as follows:
Lencoya Crawford $11,000
Coleshawn Mitchell $ 5,000
Shawn Mitchell $40,000
Whereas, the Department of Law will seek approval of the settlement of the minor's claims from the presiding judge once the settlement is approved by Council; and
Whereas, the Department of Law recommends that this case be compromised and settled and that the amount of $57,000.00 be paid from the Self Insured Liability Fund.
Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:
Section 1. The Department of Law is authorized to compromise and settle the lawsuit of Quinten Crawford, et.al. v. Metropolitan Government, et al., No. 01C-552 for the sum of $57,000.00, and directing that this amount be paid from the Self Insured Liability Account.
Section 2. This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
