RESOLUTION NO. RS2004-429
A resolution requesting the Tennessee State Department of Transportation to consider creative funding measures to construct sound barriers on Interstate 65 in the vicinity of the City of Oak Hill in Davidson County.
WHEREAS, throughout the past several years with the expansion of lanes on Interstate 65 in the Oak Hill area of Davidson County, and with increased traffic on the interstate, it has resulted in an increase in noise to this residential community; and
WHEREAS, sound barriers erected on limited access highways within the area of Davidson County have been beneficial to the residents of Davidson County; and
WHEREAS, the City of Oak Hill will not qualify for Type II funding from the federal government since it did not meet funding requirements for Type I funding for noise abatement; and
WHEREAS, as the City of Oak Hill’s Land Use Policy residential density is restricted, which prohibits it from meeting standards for federal abatement program funding available through the State of Tennessee; and
WHEREAS, since it is likely that a request by citizens of the City of Oak Hill would be evaluated for such a request if state funding is made available; and
WHEREAS, three public and private schools with over 3,000 students and a substantial number of residences are impacted by the noise from the Interstate 65 corridor, and will continue to be negatively impacted on this most highly traveled segment of Interstate 65; and
WHEREAS, it is fitting and proper that such sound barriers be erected on Interstate 65 in the area of the City of Oak Hill.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. The Metropolitan County Council hereby goes on record as requesting the Tennessee State Department of Transportation (TDOT) to consider creative funding measures to construct sound barriers on Interstate 65 in the vicinity of the City of Oak Hill in Davidson County.
Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to TDOT Commissioner Gerald Nicely.
Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
