A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of The Metropolitan Government of Nashville and Davidson County against Samir Patel and Govindbhai Patel in the amount of $10,593.00.

Whereas, on April 10, 2004, as the plaintiff, David B. Hazzard, an employee of the Metropolitan Police Department of the Metropolitan Government of Nashville and Davidson County, was operating his motorcycle in the course and scope of his employment at or near 4th Avenue South and Broadway and was struck by a motor vehicle being driven by Samir Patel and owned by Govindbhai Patel; and

Whereas, a lawsuit was filed by Metropolitan employee and plaintiff, David B. Hazzard, in the Second Circuit Court for Davidson County, Tennessee; and

Whereas, the Metropolitan Government has a subrogation interest in this lawsuit relating to the injury-on-duty pay and medical expense received by employee, David B. Hazzard; and

Whereas, after investigation, the Metropolitan Government Department of Law believes the settlement amount as set forth in Section 1 is fair and reasonable and recommends that this lawsuit be compromised and settled.

Now, therefore, be it resolved by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle its subrogation interest relating to the lawsuit of Metropolitan employee, David B. Hazzard v. Samir Patel, et al., currently pending in the Second Circuit Court, Docket No. 05C-1044, for the sum of $10,593.00, and that this amount be deposited into the appropriate fund and account as determined by the Department of Finance.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
