RESOLUTION NO. RS2015-1541
A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s claims against Shlomo Eplboim, Epandco Real Estate, LLC and Epandco Holdings, LLC for the amount of $15,000 and entry of a permanent injunction to monitor future compliance with the Metro Code of Laws.
WHEREAS, the Metropolitan Government brought two lawsuits to require Shlomo Eplboim, Epandco Real Estate, LLC and Epandco Holdings, LLC to remedy violations of the Metropolitan Code at River Village Apartments, and
WHEREAS, the Metropolitan Government and the State entered an intergovernmental agreement regarding this property (RS 2014-1209), in which the State agreed to clean up the property and the Metropolitan Government agreed to direct any cleanup costs recovered in its lawsuits to the State, and
WHEREAS, Urban Housing Solutions purchased the property and has reimbursed the State for the cost of cleanup; has paid the Metropolitan Government the 2010-2014 property taxes that were delinquent ($94,672.67); and will build affordable housing on the site, and
WHEREAS, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government; the Department of Law recommends that its claims against Shlomo Eplboim, Epandco Real Estate, LLC and Epandco Holdings, LLC be resolved,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims against Shlomo Eplboim, Epandco Real Estate, LLC and Epandco Holdings, LLC for the amount of $15,000.00, and for permanent injunctive relief that will allow the Metropolitan Government to monitor future compliance by Shlomo Eplboim, Epandco Real Estate, LLC and Epandco Holdings, LLC with the Metropolitan Code of Laws.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
