A resolution authorizing the Director of Public Property, or his designee, to exercise an option to acquire real property by purchase as part of the Clean Water Nashville Overflow Abatement Program (Proposal No. 2017M-037PR-001).

WHEREAS, pursuant to the terms of the option agreement attached hereto and incorporated herein as Exhibit A the Metropolitan Government holds an option to purchase those certain real properties (as shown on Exhibit B), located at 864 Idlewild Drive, 0 Fernbank, 826 Idlewild Drive, and 0 Yale Avenue; and,

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides:

Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and,

WHEREAS, the Metropolitan Council previously passed BL2014-783 and RS2016-200 authorizing the acquisition of the properties at 864 Idlewild Drive, 0 Fernbank and 826 Idlewild Drive for the Gibson Creek Equalization Facility Project (Project No. 11-SC-0139); and,

WHEREAS, The Metropolitan Planning Commission approved mandatory referral No. 2014M-007PR-001 on February 28, 2014 and 2016M-014PR-001 on April 15, 2016 for acquisition of the properties located at 864 Idlewild Drive, 0 Fernbank and 826 Idlewild Drive; and,

WHEREAS, the Director of Public Property has negotiated to also purchase a 4th contiguous property that is approximately 0.05 acre tract at 0 Yale Avenue, as approved by Metropolitan Planning Commission mandatory referral 2017M-037PR-001 on July __, 2017; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the purchase of said properties;


Section 1. The Director of Public Property, or his designee, is hereby authorized to exercise the option to purchase those properties located at 864 Idlewild Drive, 0 Fernbank, 826 Idlewild Drive and 0 Yale Avenue in Nashville, TN (also known as Davidson County Tax Map 052-05-0 Parcels 168.00, 178.00, 112.00 & 134.00) and as described in Exhibit A and to execute the necessary documents pertaining thereto.

Section 2. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
