Pursuant to Chapter 2.106 of the Metropolitan Code, as limited by Tennessee Code Annotated 38-8-301 and –312, the Nashville Community Review Board (NCRB) has the authority to review investigations by the Department’s Office of Professional Accountability (OPA) of allegations of misconduct by Metropolitan Nashville Police Department (MNPD) Police Officers.
Following the review, the NCRB Executive Director creates a Compliance Review Report (CRR) which:
- Contains a copy of OPA’s case summary, or referral action form,
- any documentation of disciplinary action pertaining to the case,
- any recommendations for improvement of law enforcement policies or activities,
- and, in cases where OPA’s investigation changed the designation of any or all allegations, a determination regarding the initial allegation(s) in the complaint.
If the executive director determines that OPA’s investigation is incomplete, the executive director shall then notify the committee at its next regularly scheduled meeting, that, in the Executive Director's opinion, additional investigation or additional time may be required for the investigation to be complete.
The Community Review Board receives the Compliance Review Report which is made public prior to the Executive Director’s presentation to the Community Review Board. The Complainant and the Police Department officer/employee will be given notice of the posting and provided the date the Compliance Review Report will be considered by the Board.
Following the presentation, the Community Review Board will review and discuss the information contained within the CRR. Under its own rules, the Board is not permitted to conduct its own reviews and must rely on the information contained within the Report. At the conclusion of their discussion, the Board may vote to
- accept the Report as submitted.
- accept, but modify the Compliance Review Report based on information in the report.
- reject the CRR based on information in the report and, based on information contained therein, reach a different conclusion, and return the CRR to the NCRB staff for further review or analysis.
An accepted report is forwarded to the Chief of Police who will review and provide a written response to the CRR within forty-five calendar days.
