Justin Brake, 38, is charged with vehicular homicide by recklessness, false reporting, evidence tampering, and driving on a revoked license for the April 25th collision in the 4400 block of Lebanon Pike that killed motorcyclist Jeremy Whitaker, 47.
Both Brake and his girlfriend, Gabriella Wolcott, 31, told officers that Wolcott had been driving. Fatal crash investigators reviewed surveillance video that showed that it was actually Brake who was behind the wheel.
The investigation showed that Brake pulled out of the Walmart parking lot and did not come to a full stop prior to impact with the motorcycle or provide adequate lookout to determine that it was safe to enter the roadway. Brake is being held on $110,000 bond.
Warrants charging Wolcott with facilitation of vehicular homicide by recklessness, false reporting, facilitating evidence tampering, and facilitating driving on a suspended license have also been issued.
